Welcome to LiferWatch. These Terms and Conditions (“Terms”) govern your use of the LiferWatch mobile application (the “App”) provided by Parsus Solutions, LLC (“we,” “our,” or “us”). By downloading or using the App, you agree to be bound by these Terms.

1. Use of the App
LiferWatch is a tool designed to help birders track sightings and sync with eBird. You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the App.

2. Eligibility
The App is available for users worldwide. If you are under the age of 13, you may only use the App with the consent and supervision of a parent or legal guardian.

3. License and Fees
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. The App is currently provided free of charge. We reserve the right to modify or discontinue the App or any of its features at any time.

4. Intellectual Property
All content, logos, graphics, and software associated with LiferWatch are the property of Parsus Solutions, LLC or its licensors and are protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the App without our express written permission.

5. Third-Party Services (eBird)
The App facilitates synchronization with eBird services. Your use of eBird is subject to eBird’s own terms of service and privacy policies. We are not responsible for the availability or accuracy of data provided by eBird or any other third-party platforms.

6. Prohibited Conduct
You agree not to:
• Attempt to reverse engineer or decompile any part of the App.
• Use the App to distribute malware or harmful content.
• Interfere with the security or performance of the App.

7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, uninterrupted, or that sightings data will always be accurate.

8. Limitation of Liability
To the maximum extent permitted by law, Parsus Solutions, LLC shall not be liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the App.

9. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we handle anonymized usage and diagnostic data.

10. Termination
We reserve the right to terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

11. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Parsus Solutions, LLC is based, without regard to conflict of law principles.

12. Changes to Terms
We may update these Terms periodically. Continued use of the App after changes are posted constitutes your acceptance of the new Terms.
